摘 要

我国历史悠久,在长期发展过程中，每个民族都形成了各具民族特色的风俗文化及宗教信仰。少数民族特有的民族文化里所含的公民意识和习惯风俗不仅影响到本民族的思想和行为，在逐渐演变的过程中一些习惯风俗已经成为了其民族所遵循的行为准则。鉴于少数民族自治地方的环境的特殊情况，为了国家法律在自治地方更好的实施，及更好地保障民族地方人民的权利，国家赋予自治地方适应或变通国家法律的权力。立法变通权在立法权综合体系中是一种特殊的权力。它在民族自治地方行使自治权，促进地方社会发展具有显著的作用。与此同时，作为民族自治地方的立法机关必须正确认识到立法变通对本地方的意义，理解变通的内容，坚持变通的原则，积极促进立法变通。将变通条例符合民族区域自治法的基本原则及其地方的实际需要。虽然在民族自治机关和上级机关的共同努力下，民族地方的立法取得了一些成就，但与立法者最初立法意图还有很大差距。如果没有充分研究和完善，势必会阻碍中国民族区域自治的发展。变通权执行的好坏将直接关系到我国法治制度的有效性和法治的健康运行。变通立法权的行使也将直接关系到行使自治地方的立法权力和提高立法质量。故此，不管在理论还是实践都应大力推进立法变通权的进程。
