环境规制对企业环境责任影响机制的研究

Abstract: Although our country since ancient times, "do not die, never long", not "exhaust Ze and fishing" environmental thinking. However, after the founding of the PRC, China's rapid development of the economy, especially since the reform and opening up, and high-speed economic growth, the same impressive is the issue of environmental pollution. This paper mainly analyzes the status of corporate environmental responsibility through theoretical review, and finds out its root cause is the absence of environmental regulation. In this paper, the structural equation model is constructed by investigating the data, and SPSS18.0 and AMOS21.0 are used for reliability validity test , Regression analysis, path analysis and so on.The results of this study indicate that: 1. Environmental regulation has a positive impact on the commitment of corporate environmental responsibility; 2. altruistic motivation has a mediating role; 3. Green innovation is to adjust the relationship between institutional pressure and altruistic motivation. Finally, the author puts forward some suggestions on the construction of environmental regulation legal system, the construction of implementing agencies and the implementation of efficiency, hoping to provide reference for the fulfillment of environmental responsibility of Chinese enterprises.

1引言

1.1研究背景

虽然我国自古以来就有“不夭其生，不绝其长”、不“竭泽而渔”的环保思想。但在建国后，在工业基础薄弱的情况下为迅速发展经济不得不以资源换效益。尤其是改革开放以来，与高速的经济增长，同样令人瞩目的是环境污染问题。近年来，大气污染、雾霾、水污染等成为严重影响我国居民生活质量的突出环境问题。这是由于企业环境责任的缺失，使得大量不符合排放标准的污染物进入到环境中。企业环境责任要求企业一方面在生产经营过程中控制污染源，减少废气物排放，和严格遵守废弃物排放标准，对“三废”经处理合格后再排放到自然环境中。另一方面，要求企业对由于历史局限性造成的环境污染积极主动承担治理责任，改善生态环境，维护社会公共环境利益。

企业环境责任的缺失说明仅仅依靠市场机制无法改善我国环境污染问题，这是就需要政府的宏观调控。在我国环境规制历史中，1972年无疑是值得被铭记的一年，这一年我国开始重视环境保护。截止到目前，虽不能说我国环境规制以臻至完善，但也取得了长足的进步，形成了以《环境保护法》为核心，覆盖海洋、水、大气、噪声等方方面面的环境保护法律体系。但总体来看我国的污染问题并没有得到有效解决，甚至，在一定范围、一定行业、一定程度上有加剧的趋势。这表明我国污染方面的法律法规还不够全面、具体、详实，法律执行力度不够大。尤其是，环境规制中“两高一低”即执法成本高，守法成本高，违法成本低的现状，让公众尤为痛心，这使得我国环境规则不对企业形成有效的约束。鉴于此，本文旨在通过分析环境规制对企业环境责任的影响机制，探索出优化环境规制与促进企业承担环保责任的措施，为治理我国环境污染问题提供参考。
