随着网络技术的不断发展，越来越多的的链接形式出现互联网上，从普通链接到深度链接，从网页上的链接再到移动设备客户端上的链接。然而，链接在为我们自由遨游于互联网中提供了方便的同时，链接的滥用导致的一些消极结果乃至产生的法律纠纷也不断涌入人们的视线中，由此也引起了许多学者从技术与法律等方面的探讨。本文将以深度链接的侵权问题为切入点，来探讨如何完善信息网络传播权的保护制度，以期能对我国解决深度链接的侵权问题提供借鉴。

本文分为三个部分。第一部分介绍了链接的含义和分类。第二部分是本文的重点。在这一部分，笔者首先对信息网络传播行为这一重要概念进行了界定。接下来，笔者分别详细分析了一般深度链接、下载链接和加框链接与信息网络传播权的关系，并进行了列表说明。第三部分中笔者对如何规制深度链接行为提出了几点建议：首先是在立法层面完善相关立法；其次也要在司法层面加强实践指导；最后，除了事后的规制，更要做好事前的预防措施。

NETWORK IN DEEP LINKING

Abstract

Along with the improvement of network technique , more and more kinds of links emerged, which from common linking to deep linking, from the web to mobile client.

Network links bring us much convenience during our surfing on the Internet, however, its abuse which comes into being negative effect even legal matters has attracted people’s attention. And it triggered a large number of scholars discussing from a variety of angles such as technology and law. This article will discuss how to improve the protection to the right of communication through information network in order to help solve the infringement dispute of deep linking which brought by the abuse of web links.

This article contains three sections. In the first section , I introduce the meaning of link and several kinds of links. The second section of this article is very important , in which I define the core concept of the behavior of communication through information network. Next , I respectively analyze the connection between the right of communication through information network and deep linking , download linking and framing linking. Meanwhile , I elaborate this section via three tables. In the last section , I offer several proposals on how to solve the problem of deep linking. To be special , the first suggestion is complete legislation frame. At the same time , we should enhance the guidance of judicial practice. The last but not least , it is very essential for us to take preventive measures apart from the regulations to deep linking.

论因特网上的版权保护

——以深度链接中信息网络传播权保护为研究对象

前 言

因特网上的版权问题是近些年出现的全新的边缘领域和交叉领域，需要我们将因特网理论和版权理论有机地结和在一起，同时要求技术专家懂版权，版权专家也要懂因特网。随着因特网的逐步发展，出现了改变世界的万维网（即“World Wide Web”，简称“WWW”）。万维网上的超文本链接（hypertext links）技术使网络用户不仅可以访问存储于自己服务器上的信息，还能够利用超文本链接跳跃地访问存储于其他服务器上的各种信息。随着因特网的迅速发展，日益改变了人类的生活方式，但另一方面，互联网无限的复制性、变幻莫测的交互性和全球的传播性给版权保护体系带来了巨大的挑战。在如今的网络环境中如何加强对版权人利益的保护，进而稳定版权制度，达到鼓励作者创作的目标，正是延续着版权制度存在的主题。

因此，我的指导老师为我设定了“论因特网上的版权保护”这个论文题目，我也幸运地得以接触到网络版权这一新兴的领域。确定选题后老师对我进行了引导，指出关于如何加强因特网上的版权保护，需要探讨的问题很多，既可以作宏观的探讨，也可以选定因特网上版权保护的某一具体方面，拟定一个副标题，从某一个角度对此进行探讨。听完老师给我介绍的研究背景之后，我自己也在图书馆和网上的数据库进行检索，找寻关于网络版权保护的热点问题。在搜寻资料的过程中，近两年闹得沸沸扬扬的“今日头条”、“百度影音”等网络侵权问题引起了我的研究兴趣。由于这些网站或者APP [^[1]] 的侵权方式都涉及到“深度链接”这一网络技术，而这一技术从诞生起就引起了不少法律问题，怎样才能在法律框架内规制“深度链接”行为已经成为我国现行立法和司法中的难题。于是我决定通过重点研究“深度链接”的侵权问题来探索因特网上的版权保护这一宏大的主题。
