摘 要

改编权作为著作权法中一项重要的著作财产权,近年来作品改编权纠纷案件数量也在不断增加。相比其他著作权利,学界对改编权的关注度不高,相关研究也不够深入,作品改编侵权认定尚未形成较为统一的标准。司法实践中对改编权与复制权等其他著作权利不加区分地混同使用,造成请求权基础与侵权责任不匹配的情形时有发生,给法院依法裁判带来不便的同时,也不利于维护自身的合法权益。

因此,本文试图通过对改编权既有理论的探讨以明确改编权的权利范畴,并结合司法实践中的典型案例对现有规则的具体适用情况进行分析,以期能够提炼出建设性建议,为改编权侵权的理论研究与实务工作提供帮助。

第一部分:作品改编权的理论探讨。从现有纠纷中对“改编”的理解出发,通过学理界定和法律解读,了解改编权的含义;并通过明确与改编权相关联的著作权项进行辨析,深入剖析改编权的权利内容。

第二部分:改编权的权利范围界定。要想制定体系化的改编权认定规则,首先要明确改编权的权利范围。本章从作品的类型化改变方式及作品的独创性认定两个角度明确改编权与改编行为之间的关系;并联系司法实务分析改编权的限制因素,以求进一步具象化改编权的权利范围。

第三部分:改编权权利范围界定后的侵权判定。这一部分是文章的重点部分,通过前文对改编权的理论分析与权利范围的界定,侵权判定规则制定的重要性予以凸显。此章以文学作品改编为影视作品这一潮流为背景,由中国裁判文书网的数据得出近年来涉及改编权的案件数量和主要案由,并通过典型案例分析判定规则适用情况及存在的问题。

第四部分:完善改编权侵权认定规则的建议。首先通过对传统改变侵权模式的理论改进提炼出“新三步法”,并加以说明;接着,从客观现实角度对改编权的侵权认定过程提出具体的针对性建议。

ABSTRACT

As an important copyright property right in the copyright law, the right to make alterations has increased the number of disputes over the right to adapt the works in recent years. Compared with other copyrights, academics have paid less attention to the right of adaptation and related research is not deep enough. The identification of infringement of works has not yet formed a more uniform standard. In judiciary practice, other copyrights, such as the right of adaptation and reproduction, are mixed and used indiscriminately, resulting in the fact that the basis for requesting rights does not match the tort liability,which brings inconvenience to the court and is not conducive to the maintenance of its legitimate rights and interests.

Therefore, this article tries to analyze the right category of the right of adaptation by discussing the theory of the right of adaptation, and analyze the specific application of the existing rules in combination with the typical cases in the judicial practice, in order to refine constructive suggestions and provide help for the theoretical research and practical work of the right infringement.

The first part: the theoretical discussion of the right of adaptation of the works. From the understanding of "adaptation" in the existing disputes, the meaning of the right of adaptation is understood through academic definition and legal interpretation, and the content of the right of adaptation is deeply analyzed through the identification of the copyright items associated with the right of adaptation.

The second part: the definition of the right scope of the right of adaptation. In order to formulate a systematic rule of determining the right to adapt, we must first clarify the scope of the right of adaptation. This chapter clearly defines the relationship between the right of adaptation and the adaptation of the works from the two angles of the type of work and the originality of the work, and analyzes the restrictive factors of the right of adaptation in connection with the judicial practice in order to further the right scope of the right of adaptation.

The third part: the infringement judgment after the definition of the scope of the right of adaptation. This part is the key part of the article. Through the previous study of the theoretical analysis of the right of adaptation and the definition of the scope of the right, the importance of the determination of the rules of the infringement judgment is highlighted. In this chapter, the trend of adaptation of literary works to film and television works is the background, the number of cases involving the right of adaptation in recent years and the main causes are obtained from the data of the Chinese referee's document network, and the application and problems of the rules are analyzed by typical cases.

The fourth part: the suggestions for improving the rules of tort identification. First of all, the "new three steps" was extracted from the theoretical improvement of the traditional mode of changing the tort. Then, the specific suggestions were put forward from the objective reality point of view.
